Donating Easements & Selling Credits

A Conservation Opportunity for Virginia Landowners

Virginia FarmDo you want to permanently protect what you love about your land, such as its scenic beauty, wildlife habitat, historic buildings, or its ability to provide a farming or forestry livelihood? If so, you may want to consider donating a conservation easement.

  • A conservation easement is conveyed by a landowner to a non-profit organization or government agency, and it places certain limits on the use and development of the landowner’s land in perpetuity to achieve various conservation goals while allowing the landowner to retain private ownership of the land. A conservation easement is legally binding on all future landowners, and will protect the land forever from inappropriate development and uses. See our Introduction to Donating page for a quick overview.
  • A Virginia landowner who protects his or her land through a conservation easement donation may be eligible for certain state and federal tax benefits, including a transferable state income tax credit equal to 40 percent of the value of the easement. For more details on potential tax benefits, see Potential Tax Benefits.
  • Conservation Partners consults with landowners and their advisors throughout the complex process of donating conservation easements and preparing and registering high-quality land preservation tax credits that meet our Quality Standards. In most cases, after an easement donor’s credit is registered, we help the donor market and sell some or all of the credit to individuals and businesses who are enthusiastic about purchasing high-quality credits and supporting land conservation in Virginia.
  • Easement donors can use the proceeds from their credit sales to buy more land, pay down debt, or save for retirement, all without having to sell a single acre of the land they love.
